South Sioux City man sentenced in child porn caseBy Paul Buum, Editor/PublisherELK POINT – A South Sioux City, NE, man was sentenced October 29 in Union County Circuit Court to seven years in the South Dakota State Penitentiary for Possession of Child Pornography, a class 4 felony.Bruce E. Kelly was arrested April 26 after the South Dakota Department of Criminal Investigation was alerted to the alleged presence of child pornography on his workstation computer at Aladdin Industries in Elk Point. Kelly was taken into custody along with what Union County State’s Attorney Jerry Miller called a substantial amount of illegal child pornography.
Kelly pleaded guilty September 17 to one count of Possession of Child Pornography. He was sentenced October 29 to seven years in the state penitentiary, which was suspended. Kelly was ordered to serve 100 days in the Union County Jail and be placed on supervised probation for five years. He must also waive his right to have a computer with Internet access at his workplace or residence that is not approved by Court Services with any recommended filters to be installed, not possess any pornographic material, successfully complete treatment and after-care recommendations, and register as a sex offender.Kelly was also fined $2,500 and assessed $1,826 in restitution and court costs, which must be paid within 30 days from sentencing. |
